Welcome to FoxTekno. These Terms of Service ("Terms") govern your access to and use of the FoxTekno AI Customer Support Platform (the "Service") operated by FoxTekno ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

FoxTekno is a Software-as-a-Service (SaaS) platform that provides AI-powered automated customer support for businesses. The Service enables you to:

• Connect your social media accounts (Instagram, Facebook, WhatsApp, Telegram) to our platform
• Automatically respond to customer messages using AI technology
• Monitor and manage customer conversations through a centralized dashboard
• Track messaging usage and analytics

2. Account Registration

To use the Service, you must:

• Create an account with a valid email address and password
• Provide accurate and complete registration information
• Be at least 18 years of age
• Be authorized to act on behalf of the business you are registering

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Subscription Plans

The Service is offered through tiered subscription plans:

• Starter: Basic features with limited message volume and channel connections
• Pro: Enhanced features with higher message limits and additional channels
• Enterprise: Full features with custom message limits and priority support

Plan details, pricing, and message limits are displayed in the Service dashboard and may be updated from time to time with prior notice.

4. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or bulk messaging
• Violate any applicable laws or regulations
• Infringe upon the rights of third parties
• Transmit malicious code, viruses, or harmful content
• Impersonate another person or entity
• Attempt to gain unauthorized access to the Service or its infrastructure
• Use the AI-generated responses for deceptive, fraudulent, or harmful purposes
• Violate the terms of service of connected third-party platforms (Meta, WhatsApp, Telegram)

5. Social Media Platform Compliance

When using the Service with third-party platforms, you must comply with their respective terms:

• Telegram Terms of Service

You are solely responsible for ensuring your use of the Service complies with these third-party terms. We are not liable for any actions taken by these platforms against your accounts.

6. AI-Generated Content

The Service uses AI technology (powered by Google Gemini) to generate automated responses. You acknowledge that:

• AI-generated responses may not always be accurate or appropriate
• You are responsible for configuring and monitoring the AI system prompts
• You should review AI performance regularly and adjust settings as needed
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

8. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by FoxTekno and is protected by intellectual property laws. You retain ownership of your data and content processed through the Service.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (with advance notice when possible)
• System updates and improvements
• Force majeure events beyond our control
• Third-party service outages (Meta, WhatsApp, Telegram APIs)

10. Limitation of Liability

To the maximum extent permitted by law, FoxTekno shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claims related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Account Termination

You may terminate your account at any time through the Service dashboard or by contacting us. We may terminate or suspend your account if:

• You violate these Terms
• You engage in abusive or fraudulent activity
• Your account remains inactive for an extended period
• Required by law or platform policies

Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be resolved in the courts of Turkey.
